Terms of Use

These terms are the agreement between you and Pypple Tech for the use of Yolky. They cover what you're allowed to do with the app, how the subscription works, and what you should and shouldn't rely on a generated recipe for.

1. Accepting these terms

By downloading, installing or using Yolky you agree to these Terms of Use. If you do not agree, do not use the app. If you are under the age of majority where you live, you may use Yolky only with the involvement of a parent or guardian who agrees to these terms. You must be at least 13 years old to use Yolky.

"We", "us" and "Pypple Tech" mean Pypple Tech, a company registered in the State of Wyoming, United States. "You" means the person using the app.

2. Your licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Yolky on Apple-branded devices that you own or control, for your own non-commercial use, in accordance with the App Store Terms of Service. This licence does not transfer any ownership to you.

3. Your account

Yolky creates an account for you so your cookbook can follow you. You are responsible for activity under your account and for keeping your sign-in method secure. Tell us promptly at hello@pyppletech.com if you believe your account has been used without your permission.

4. Subscriptions and billing

Yolky Pro is an auto-renewing subscription sold through the App Store. The plans are:

Prices are shown in your local currency in the app and may vary by territory and with local taxes. The price you see at purchase is the price that applies.

• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price of the plan you selected.
• You can manage your subscription and turn off auto-renew in your Apple ID account settings after purchase.
• If we change the price of a plan you already hold, Apple will ask you to consent before the new price takes effect.

5. Free trial

The yearly plan may be offered with a 3-day free trial. If you do not cancel at least 24 hours before the trial ends, it converts automatically into a paid subscription and your Apple ID is charged. Any unused portion of a free trial is forfeited when you purchase a subscription. Free trials are limited to one per Apple ID and are not available where Apple does not offer them.

6. Cancelling and refunds

To cancel: open the Settings app on your iPhone → tap your name → Subscriptions → Yolky → Cancel Subscription. You keep access until the end of the period you have already paid for.

Because purchases are made through the App Store, refunds are handled by Apple, not by us. Request one at reportaproblem.apple.com. We cannot issue, guarantee or reverse an App Store refund. Consumers in the EU, UK and other jurisdictions with statutory withdrawal or cancellation rights keep those rights in full.

Deleting the app does not cancel your subscription.

7. Recipes are AI-generated — what that means

Yolky uses an AI model to look at your photo or link and produce a recipe. That recipe is a reconstruction, not a retrieved original. It is our best attempt at how a dish like the one in your photo could be made.

• Ingredients, quantities, cooking times and nutrition figures are estimates.
• Yolky may misidentify a dish, miss an ingredient it cannot see, or produce a recipe that differs from the one that actually made the food in your photo.
• Nutrition information is an approximation and is not medical, dietary or nutritional advice. Do not rely on it to manage a medical condition. Speak to a qualified professional for that.
• You are responsible for judging whether a recipe is sensible before you cook it.

8. Food safety and allergies

To the fullest extent permitted by law, we are not liable for illness, allergic reaction or other harm arising from food prepared using a recipe produced by the app.

9. Your content

You keep ownership of the photos, links and notes you put into Yolky ("your content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process and display your content solely in order to operate the app for you — that is, to generate your recipes and show them back to you. This licence ends when you delete the content or your account.

You confirm you have the right to submit whatever you send, and that doing so does not infringe anyone else's rights. Do not upload other people's copyrighted material where you have no right to do so.

Recipes generated for you are yours to cook, adapt and share as you like. Note that in most jurisdictions a plain list of ingredients is not protected by copyright, while the written expression of the method may be.

10. Acceptable use

You agree not to:

• use Yolky for anything unlawful, or to submit content that is illegal, abusive or obscene;
• attempt to reverse-engineer, decompile or extract the source of the app, except where that restriction is prohibited by law;
• use automated means to access the service, resell it, or circumvent usage limits, rate limits or the paywall;
• interfere with the service's operation, or attempt to gain access to accounts or systems that are not yours;
• use Yolky to build a competing product or dataset.

11. Our intellectual property

Yolky, the Yolky name, the Yolky character and mascot, the app's design, code and artwork are owned by Pypple Tech and protected by intellectual property law. Nothing in these terms transfers those rights to you.

12. Third-party services

Yolky relies on third-party services to work, including Apple, Google Cloud and Google's Vertex AI, RevenueCat and Mixpanel. Importing a link may involve retrieving publicly available data from the platform that link points to. Your use of those platforms is governed by their own terms. We are not responsible for third-party services, and we are not affiliated with, endorsed by or sponsored by TikTok, Instagram, Meta or Apple.

13. Disclaimer of warranties

To the fullest extent permitted by law, Yolky is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any recipe it produces will be accurate or suitable for you. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, Pypple Tech will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising out of or relating to your use of Yolky.

Our total aggregate liability arising out of or relating to these terms or the app is limited to the greater of (a) the amount you paid us for Yolky in the twelve months before the event giving rise to the claim, or (b) US$50.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all mandatory statutory rights under the law of your country of residence, and nothing here overrides them.

15. Indemnity

You agree to indemnify and hold Pypple Tech harmless from claims, damages and reasonable legal costs arising from your breach of these terms, your misuse of the app, or content you submitted that you had no right to submit. This does not apply to consumers to the extent such an obligation would be unenforceable under the consumer law that applies to you.

16. Suspension and termination

You can stop using Yolky at any time and delete your account from the app's Settings screen, or via the deletion request page. We may suspend or terminate access if you materially breach these terms, or if we are required to by law. Where it is reasonable to do so, we will give notice first. Sections that by their nature should survive termination — content licences you have already granted for content you keep stored, disclaimers, liability limits, indemnity and governing law — survive.

17. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Wyoming, and you and we consent to the jurisdiction of those courts.

If you are a consumer resident in the EU, the UK or another jurisdiction whose law gives you the right to bring proceedings in your local courts and to the protection of your local mandatory consumer law, this section does not take that right away.

18. Apple-required terms

These terms are between you and Pypple Tech only, not Apple. Apple is not responsible for Yolky or its content. Specifically:

• Apple has no obligation to provide any maintenance or support for Yolky.
• If Yolky fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Yolky.
• Pypple Tech, not Apple, is responsible for addressing any claims relating to Yolky — including product liability claims, any claim that Yolky fails to conform to a legal requirement, and claims under consumer protection or similar legislation.
• Pypple Tech, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that Yolky infringes that party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms, and upon your acceptance Apple will have the right to enforce them against you.

19. Changes to these terms

We may update these terms. If a change is material we will tell you in the app or by email before it takes effect. Continuing to use Yolky after a change takes effect means you accept the updated terms. If you don't accept them, stop using the app and delete your account.
